Terms of Service

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration, and to keep your account information updated. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

The Service is intended for use by real estate professionals and businesses. You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet these eligibility requirements.

You are responsible for maintaining the security of your account. You must notify us immediately at contact@yapii.com if you suspect unauthorized access to your account. We are not liable for losses arising from unauthorized use of your account credentials.

Send unsolicited commercial messages (spam) or use the Service to contact individuals who have not provided valid consent to receive communications from you, as required by the CAN-SPAM Act, TCPA, CASL, or other applicable laws.

Use the Service to harass, threaten, or harm any individual.

Upload or distribute malware, viruses, or other malicious code.

Attempt to gain unauthorized access to any part of the Service or its infrastructure.

Use the Service to engage in any fraudulent, deceptive, or misleading activity.

Violate any applicable law or regulation, including real estate fair housing laws and data protection regulations.

Resell, sublicense, or otherwise transfer access to the Service to third parties without our written consent.

Scrape, crawl, or use automated tools to extract data from the Service beyond what is expressly permitted by our API.

You are solely responsible for ensuring that your contact database complies with applicable data protection laws, including obtaining required consents for email and SMS marketing. Yapii provides tools and compliance features to assist you, but ultimate compliance responsibility rests with you.

Yapii offers subscription plans billed monthly or annually. Fees for your selected plan are described on the Pricing page at yapii.com/pricing. All fees are stated in US dollars and are exclusive of applicable taxes.

Payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge the applicable fees to your payment method on a recurring basis. You represent that you are authorized to use the payment method you provide.

Subscription fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. Cancellations require 30 days' notice: when you cancel, your subscription remains active, and you remain responsible for applicable fees, until the later of the end of your current billing period and 30 days from the date of your cancellation request.

We may change subscription fees with 30 days' advance notice. Continued use of the Service after the price change takes effect constitutes acceptance of the new pricing.

If any amount remains unpaid 15 days after it is due, the overdue balance accrues a late charge of 1.5% per month, or the highest rate permitted by law if lower, until paid. We may also suspend the Service until all overdue amounts are paid.

If a charge fails, we may retry it and may charge any other payment method on file for your account. You authorize us to receive updated payment method details from your card issuer or card network (for example, a new card number or expiration date) and to charge the updated payment method.

If you believe a charge is wrong, contact us at contact@yapii.com within 60 days of the charge and we will work with you in good faith to resolve it. Disputing a valid charge with your bank or card issuer instead of contacting us is a breach of these Terms. If you dispute a valid charge, the amount remains owed, you agree to pay any fees we incur because of the dispute, and we may suspend your account until it is resolved.

If your account becomes past due, you agree to pay all reasonable costs we incur to collect the overdue amount, including collection agency fees, reasonable attorneys' fees, and court or arbitration costs, to the extent permitted by law. We may refer or assign past-due amounts to a third-party collection agency, which may contact you as described in Section 5.9. We may report past-due business accounts to commercial credit reporting agencies.

You agree that Yapii, and anyone collecting amounts owed to Yapii on our behalf, including a collection agency, may contact you about your account, billing, payments and any amount you owe by email, phone call and text message (SMS or MMS), at any email address or phone number you give us or that is associated with your account, including mobile numbers. These calls and texts may use automated technology, an automatic telephone dialing system, prerecorded messages, or an artificial or AI-generated voice. They are account and collection communications, not marketing. Message and data rates may apply. You may withdraw your consent to automated, prerecorded or AI-voice calls and texts at any time by replying STOP to a text or emailing contact@yapii.com. Withdrawing consent does not cancel any amount you owe, and we may still contact you by other lawful means. You agree to keep your contact information current. We will place calls during reasonable hours.

Your obligation to pay amounts owed, and Sections 5.5 through 5.9, survive cancellation or termination of your account.

If you create an account on behalf of a business or other organization, you and that organization are jointly responsible for all fees and other amounts owed under these Terms.

The Service, including all software, algorithms, models, designs, text, graphics, and other content developed by Yapii, is owned by Yapii LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the Service as described herein.

You retain all rights to the data you upload to the Service, including your contact database. You grant Yapii a limited license to use your data solely to provide and improve the Service as described in our Privacy Policy. We do not claim ownership of your data.

If you provide feedback, suggestions, or ideas about the Service, you grant Yapii a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

You may request cancellation of your subscription at any time through your account settings. Cancellation takes effect on 30 days' notice: your access to the Service, and your responsibility for applicable fees, continue until the later of the end of your current billing period and 30 days from the date of your cancellation request. After that date, your account will be deactivated.

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in conduct that we determine is harmful to other users or to the Service, fail to pay applicable fees, or if required by law.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days following termination, during which time you may request an export. After 90 days, your data will be deleted from our systems in accordance with our data retention practices.

By providing your mobile number and agreeing to receive text messages, you consent to receive messages from the real estate agent you contacted about your inquiry: replies to your questions, appointment confirmations and reminders, and follow-up on a home valuation you requested. Consent is optional and is never a condition of purchasing any goods or services.

Message frequency varies based on your conversation with the agent. Message and data rates may apply. Yapii does not charge for the messages themselves; any charges come from your mobile carrier under your own plan.

Reply STOP to any message to stop receiving texts; you will receive one confirmation and no further messages. Reply HELP for help, or contact contact@yapii.com. You may also opt out using the control on your dashboard.

Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device and cannot be guaranteed. Supported carriers may change without notice.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are never shared with any third parties. See the Privacy Policy at https://yapii.com/privacy for full details.

Program name: Yapii Sales, operated by Yapii LLC. Real estate agents, brokers, and other business contacts who ask about Yapii can opt in at https://yapii.com/walkthrough by checking an optional box, unchecked by default, next to their mobile number. Consent is never a condition of a walkthrough or any purchase.

Messages cover your walkthrough request, booking confirmations and reminders, answers to your questions about Yapii, and follow-up about Yapii. Message frequency varies, up to about 8 messages per month. Message and data rates may apply.

Reply STOP to any message to opt out; you will receive one confirmation and no further messages. Reply HELP for help, or contact contact@yapii.com.
